O.C.G.A. 33-7-11 and 40-9-37. - Georgia is an at-fault (tort) state. There is no personal injury protection (PIP) requirement; Georgia has used a compulsory liability system since October 1, 1991. Medical payments (MedPay) coverage is optional. - Uninsured/underinsured motorist (UM/UIM) coverage must be included on a Georgia policy unless the named insured rejects it in writing. O.C.G.A. 33-7-11. - Georgia UM comes in two forms. "Added-on" (the default) pays on top of the at-fault driver's liability limits. "Reduced-by" pays only the difference between the at-fault driver's limits and your UM limits, and applies only if you choose it in writing. - Proof of insurance is tracked electronically through GEICS, the Georgia Department of Revenue's insurance database. Insurers report each VIN, so the VIN on a policy must match the vehicle exactly. - A lapse in coverage on a registered vehicle triggers a $25 Department of Revenue lapse fee, additional fees if unpaid, and possible registration suspension. See dor.georgia.gov for current amounts. - Georgia uses modified comparative fault: an injured person's recovery is reduced by their share of fault, and a person 50% or more at fault recovers nothing. O.C.G.A. 51-12-33. - The deadline to sue is generally 2 years for personal injury (O.C.G.A. 9-3-33) and 4 years for damage to a vehicle or other property (O.C.G.A. 9-3-31). - The Hands-Free Georgia Act (O.C.G.A. 40-6-241) bars drivers from holding or supporting a phone while driving. - Average Georgia auto premiums are estimates only: Experian (October 2026) puts full coverage at about $3,834 a year and minimum coverage at about $2,400 a year. Individual rates vary widely. ### Georgia home - Georgia's main property perils are severe thunderstorms, hail, tornadoes, inland flooding and wind and rain from tropical systems, plus occasional hard freezes (GEMA 2022 Hazard Identification and Risk Assessment). - Tornado season generally runs March through May; hurricane season runs June 1 to November 30. Tropical systems can bring heavy rain and wind well inland, as Hurricane Helene did in 2024. - Some Georgia policies carry a separate wind/hail or hurricane deductible, so it's worth checking the declarations page at every renewal. - Standard homeowners and renters policies generally cover sudden water damage from burst pipes (Georgia Office of Commissioner of Insurance and Safety Fire). - Standard homeowners policies do not cover flood. - The Georgia Underwriting Association (GUA) is Georgia's FAIR Plan, an insurer of last resort for property owners who can't find coverage in the standard market. GUA: (404) 923-7431. - Average Georgia homeowners premium is an estimate only: NerdWallet (February 2026) puts it at about $3,225 a year for a $400,000 dwelling. ### Flood - Standard homeowners policies do not cover flood. Flood insurance is available through the National Flood Insurance Program (NFIP) where the community participates, and through private flood carriers. - NFIP limits for a single-family home: up to $250,000 for the building and $100,000 for contents. Renters can buy contents coverage up to $100,000. - Most NFIP policies take effect 30 days after purchase, unless bought as part of a mortgage transaction. - Clayton County has many creeks and Flint River headwaters. To check a specific address, use the FEMA Flood Map Service Center at https://msc.fema.gov/. ### Condo - Under the Georgia Condominium Act (O.C.G.A. 44-3-107), the association's master policy must cover the property at full insurable replacement cost, less deductibles, unless the declaration says otherwise. That includes common elements and many in-unit fixtures. The association must also carry general liability of at least $1 million per occurrence and $2 million aggregate. - Under O.C.G.A. 44-3-94, an association may pass up to $5,000 per loss of its master-policy deductible to the affected unit owners. Loss assessment coverage on an HO-6 policy helps with that. ### Renters - A landlord's policy covers the building, not a tenant's belongings. Renters insurance covers personal property, liability and loss of use. Many leases require it. - For Georgia leases entered or renewed on or after July 1, 2024, security deposits are capped at two months' rent (O.C.G.A. 44-7-30.1). Landlords must return the deposit, or an itemized list of deductions, within 30 days after getting the unit back (O.C.G.A. 44-7-34). ### Landlord - Rental homes are usually insured on a dwelling policy such as a DP-3 rather than a homeowners policy, with options for loss of rent and liability. ### Life - All Access Agency offers term and permanent life insurance. Life insurance is offered and issued by third-party insurance companies. ### Business - Georgia requires workers' compensation for any business with three or more employees, including regular part-time workers (State Board of Workers' Compensation). - A business owner's policy (BOP), which bundles property and general liability for small businesses, is not legally required but is common. The agency also quotes commercial auto, general liability and specialty coverage, including hard-to-place risks through its other carriers. ### Motorcycle - Georgia has a universal helmet law: every operator and passenger must wear approved protective headgear (O.C.G.A. 40-6-315). - Riders need eye protection if the motorcycle has no windshield. ### RV, boat and ATV - RV, boat and ATV coverage is available through the agency's primary carrier or one of its other carriers, depending on the vehicle. - Georgia boaters born on or after January 1, 1998 must complete an approved boater education course to operate a motorized vessel (Georgia DNR). - Boating under the influence is illegal at 0.08 BAC for age 21 and older and 0.02 for under 21 (Georgia DNR). - Georgia law does not require boat insurance, but lenders and marinas may. ### Regulator - Georgia Office of Commissioner of Insurance and Safety Fire, Consumer Services: (404) 656-2070, or (800) 656-2298 toll-free.
